The Senior Investigator affirmed the decision of the HSE. He found that it was not required to create a record pursuant to section 17(4) of the Act in order to provide the information sought and that it was therefore justified in refusing the request under section 15(1)(a) on the ground that the records sought do not exist.
Health Service Executive
The Senior Investigator varied the decision of AGS. While he found that it was justified in refusing access, pursuant to section 42(b)(v), to details of two transactions, he directed the release of the remaining information.

University Hospital Limerick
The Senior Investigator varied the decision of the HSE. He found that was justified in refusing access, under section 30(1)(a), to the draft copies of the SAR report. He found that it was not justified in refusing the request for the relevant stenographer records under section 15(1)(a). He annulled that aspect of the HSE 's decision and direct it to undertake a fresh consideration of that part of the applicant's request.

The Senior Investigator varied the Department's decision. He found that the Department was justified in refusing access to the vast majority of the withheld information under sections 29(1) and 36(1)(b). He found that it was not justified in refusing access to a small amount of withheld information and directed the release of same.
